Protection for Employees Who Evacuated in Hurricane Ike

Texas law provides protection for certain employees who were discriminated against or terminated by their employers for obeying evacuation orders during Hurricane Ike.  Under Texas law an employer may not "discharge or in any other manner discriminate against an employee who leaves the employee's place of employment to participate in a general public evacuation ordered under an emergency evacuation order."  Tex. Lab. Code, Sect. 22.002.  An employer who violates the law is liable to the employee for lost wages and benefits and the employee is entitled to reinstatement.  The law does not apply to certain emergency services peresonnel.
