Fiddler Selected by Texas Super Lawyer’s Magazine

G. Scott Fiddler has been named by Texas Super Lawyers magazine as one of the top attorneys in Texas for the fifth consecutive year. Texas Super Lawyers’ insert is featured in Texas Monthly magazine.

Only five percent of the lawyers in the state are named by Super Lawyers, and the selection is made as a result of a rigorous multi-phase selection process that includes, among other things, a statewide survey of lawyers and a peer review of candidates by practice area.

Jury Verdict in FLSA Retaliation Case

On July 16, 2009, a Houston federal jury returned a verdict in favor of Glenn Miller in his wrongful termination case against Prominence Security Agency, Inc. and Donald Aikens. Miller alleged he had complained about not being paid overtime as required by the Fair Labor Standards Act (“FLSA”). When his complaints were not adequately addressed, Miller hired G. Scott Fiddler who filed suit against the company. Thereafter Miller’s hours were reduced and he was ultimately separated from the company. Miller sued for unlawful retaliation and termination under the FLSA. The jury returned a verdict finding that Prominence Security Agency, Inc. and Donald Aikens retaliated against Miller. The jury awarded Miller all the damages he sought.

Jury Verdict Against Engenyx Software Corporation, Trent T. Daniel

On November 26, 2008, a Houston jury found in favor of Natalynn Dunson-Harrison on her breach of contract and fraud claims against Engenyx Software Corporation and Trent T. Daniel respectively. Ms. Harrison alleged that Mr. Daniel and the company promised her the CEO position in the company, while never intending to allow her to perform the duties of a CEO and that the company failed to pay her salary. She also alleged that she was constructively discharged in violation of her employment agreement with the company. The jury verdict resulted in a judgment against Engenyx Software Corporation for breach of contract damages and a judgment against Trent T. Daniel for fraud damages. Ms. Harrison was represented by G. Scott Fiddler. Click here to see a copy of the Final Judgment in this case. As of the date of this posting the judgment has not been paid. Landmark Arbitration Decision from Texas Supreme Court

On August 29, 2008, the Texas Supreme Court ruled unconscionable certain provisions in an arbitration agreement that eliminated an employee’s right to seek punitive damages and reinstatement by his worker’s compensation retaliation/wrongful termination claim. G. Scott Fiddler represented the employee, Johnny Luna, in this landmark case, which was the first in which the Texas Supreme Court found provisions in an employment arbitration agreement to be substantively unconscionable. “I took this case nearly six years ago because I wanted to establish a decision that would make it easier for employees to bust unconscionable arbitration agreements,” Mr. Fiddler said. “We feel we have achieved that.” The case is In re Poly-America, L.P., 262 S.W.3d 337 (Tex. 2008).
