Jury Verdict in FLSA Retaliation Case
On July 16, 2009, a Houston federal jury returned a verdict in favor of Glenn Miller in his wrongful termination case against Prominence Security Agency, Inc. and Donald Aikens. Miller alleged he had complained about not being paid overtime as required by the Fair Labor Standards Act (“FLSA”). When his complaints were not adequately addressed, Miller hired G. Scott Fiddler who filed suit against the company. Thereafter Miller’s hours were reduced and he was ultimately separated from the company. Miller sued for unlawful retaliation and termination under the FLSA. The jury returned a verdict finding that Prominence Security Agency, Inc. and Donald Aikens retaliated against Miller. The jury awarded Miller all the damages he sought.
