Former police academy recruit wins age discrimination case

Many Texas residents already know that as the average age of United States residents increases, it is more often acknowledged that age should not make as much of a difference in many industries. However, that does not keep those in certain professions from wanting to exclude people over a certain age. This type of age discrimination is against federal and state law in many cases.

For instance, an out-of-state man filed a lawsuit in federal court alleging that he was discriminated against due to his age. The 54-year-old man was ousted from the police academy in his city in Aug. 2012. He claimed that an officer at the academy subjected him to significant discrimination based on his age before that officer terminated him from the academy.

Thereafter, the Connecticut man claimed that his health suffered. He also presented evidence to the court establishing the fact that the department did not want him as an officer based on his age. The jury agreed with the man that he was discriminated against and awarded him $65,000 in damages to be paid to him by the city of New Haven, Connecticut.

Texas employees who feel that they are victims of age discrimination might also file a lawsuit against their employers. In these cases, it is possible to seek both monetary and non-monetary damages. If the evidence supports an individual's contention that he or she was discriminated against based on age, those damages could be awarded. Of course, discrimination based on age is not the only basis for such a claim. Employees should not have to be concerned that their age, race, religion or other factors will keep them from an employment opportunity.
