What positions are exempt from FLSA overtime rules?

Among the key rules in the Fair Labor Standards Act are the rules on when overtime pay is required for workers. Now, the FLSA overtime rules don't apply to all workers. There are some positions that are considered exempt from these rules.

Some examples of positions that can be exempt from the FLSA requirements for overtime pay are:

  • Executive employees
  • Administrative employees
  • Professional employees
  • Certain computer workers
  • Babysitters
  • Farmworkers
  • Outside salespersons
  • Certain transportation workers
  • Movie theater workers

It is important to note that, within each class of exempt position, there are specific rules on what conditions have to be met for an employer to in fact be able to claim a worker as exempt. Another point of note is that, along with complying with FLSA rules when claiming exemptions from overtime requirements, it is also important for employers to comply with any additional rules present in the state in whcih they are operating.

So, it can be critical for employers to understand the exemption rules they are subject to and to carefully follow these rules when classifying employees as exempt from overtime pay requirements.
